I wonder what the OEM agreement is with Microsoft. They designed the system specifically to be upgradable, so I wonder if Toshiba is in violation of thier aggreement. In any case Microsoft should apply some pressure. This hurts them as well as Toshiba.

I doubt the OEM license requires OS upgrades. Whether or not they offer upgrades is left up to the OEM, I think, otherwise HP would be in violation for not allowing 1910 owners to upgrade.

As Microsoft doesn't have a monopoly in PDAs, they probably don't want to tick off the OEMs.
Besides, how far back do you go? Should iPAQ 3630 owners be able to upgrade to WM 2K3?
My personal philosophy is that OEMs should allow one OS upgrade for each device they produce. That would show customers they care about their investment, while not forcing them to support ancient (well, back to 2000 :)) legacy devices.
